1. Acceptance of Terms

By downloading, installing, or using AI Protein Tracker - Snap & Track (the "App"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, do not download or use the App.

2. License Grant & Use

Fuelie grants you a limited, non-exclusive, non-transferable, revocable license to use the App on your personal device for personal, non-commercial purposes only. You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Modify, translate, adapt, or create derivative works of the App
• Use the App to train artificial intelligence models, machine learning systems, or large language models without our express written consent
• Scrape, crawl, or extract data from the App or its services
• Share your account credentials with any third party
• Use the App for any illegal, fraudulent, or unauthorized purpose
• Access the App through automated means without authorization
• Use the App in any manner that could damage, disable, or impair our services

3. Health & Nutritional Information Disclaimer

The App is NOT a medical device and does not provide medical advice. Nutritional information provided by the App should not be relied upon as a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider or registered dietitian.

You assume full responsibility for your use of the nutritional information provided by the App, including any decisions you make regarding your diet and health.

4. User Account & Responsibilities

You are responsible for:

• Creating and maintaining a secure password for your account
• Maintaining the confidentiality of your account information
• All activities and actions that occur under your account
• The accuracy and appropriateness of any content you upload to the App, including food photographs

You agree to provide accurate information during account registration and to update such information as necessary.

5. Photo Processing & Data Handling

Photo Processing

When you take or upload a photograph of food to the App:

• The photo is transmitted to our backend servers and to third-party food recognition services for analysis
• The photo is processed to extract nutritional information
• Fuelie does not store your photos on our servers after processing is complete
• Photos may be temporarily retained by third-party food recognition services in accordance with their terms of service

Your Rights

You retain all ownership rights to any photographs you upload to the App. By uploading photos to the App, you grant Fuelie a limited license to process the photo for nutritional analysis and display results within your account.

6. Third-Party Services

The App relies on third-party APIs and services for:

• Food recognition and image analysis
• Nutritional database information
• Analytics and crash reporting
• Payment processing for in-app purchases

Fuelie is not responsible for the availability, accuracy, reliability, or performance of these third-party services.

7. In-App Purchases & Subscriptions

Subscription Options

The App offers both monthly and lifetime subscription plans that unlock premium features.

Payment Processing

Payments are processed through the App Store (for iOS). Your payment information is handled by Apple in accordance with their terms. Fuelie does not store your payment card information.

Billing

• Monthly subscriptions renew automatically on the same date each month
• You will be charged through your App Store account
• Prices are subject to change with 30 days' notice

Cancellation

You can cancel your subscription at any time through your App Store account settings. Cancellation takes effect at the end of your current billing period.

No Refunds

Except as required by law, all subscription payments are non-refundable. If you cancel mid-billing cycle, you will retain access to premium features through the end of that billing period.

Free Trial

If a free trial period is offered, your subscription will automatically convert to a paid subscription at the end of the trial unless cancelled beforehand.

8. Limitation of Liability

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, revenue, profits, or business opportunities
• Any claims arising from the accuracy or reliability of nutritional information
• Any health-related consequences from using the App's nutritional estimates
• Any damages resulting from third-party services, APIs, or payment processors
• Any service interruptions or technical issues
• Any unauthorized access to or alteration of your account

Your sole remedy for dissatisfaction with the App is to stop using it and request a refund as permitted by your app store or payment provider.

9. Disclaimers

Fuelie does not warrant that:

• The App will be error-free or uninterrupted
• Nutritional data will be 100% accurate or complete
• The App will meet your specific requirements
• Any defects in the App will be corrected

10. Prohibited Conduct

You agree not to:

• Violate any applicable laws, regulations, or third-party rights
• Harass, abuse, or harm other users
• Upload malicious code or attempt to disrupt the App
• Attempt to gain unauthorized access to our systems or services
• Use the App to collect personal information about other users without consent

11. Changes to Terms & Services

Fuelie reserves the right to update or modify these Terms of Use at any time, and to modify, suspend, or discontinue the App or any features within it.

Updates to these Terms will be posted within the App or on our website with a new "Last Updated" date. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

12. Account Termination

Fuelie may terminate or suspend your account if you violate these Terms of Use, our Privacy Policy, or engage in fraudulent or unauthorized activity.

Upon termination, your right to use the App ceases immediately.

13. Governing Law & Dispute Resolution

These Terms of Use are governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.

• Initial Resolution: Good faith negotiation between you and Fuelie
• Binding Arbitration: If not resolved, disputes shall be resolved through binding arbitration rather than court proceedings, except where prohibited by law

You agree to waive the right to a jury trial and class action lawsuit.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms of Use, together with our Privacy Policy, constitute the entire agreement between you and Fuelie regarding your use of the App.
